The Legal Stuff

1.1  The contents of the Korean History Project (KHP) web site (the Site) are intended for the personal, noncommercial use of persons (Users) accessing the Site via the Internet. All materials published or distributed ("Content") by KHP including, but not limited to, essays, articles, photographs, images, illustrations, audio and/or video clips are protected by copyrights owned or controlled by KHP or the party credited as the provider of the content, software, or other materials and is protected by copyright, trademark, trade secret, patent and any other applicable intellectual property and other laws. All copyrights, trademarks, servicemarks and logos appearing on this site are used with permission of their respective owners. You agree not to use, reproduce, copy or modify any part of the Site for any unlawful purpose and you agree to comply with any request from KHP or Third Parties to protect property rights of the owner of that part of the Site.

1.2  KHP contains copyrighted material, trademarks and other proprietary information including, but not limited to, text, software, photos, video, graphics, music and sound. The entire contents of KHP are protected by copyright as a collective work and/or compilation pursuant to copyright laws of the United States, international conventions and other copyright laws. User may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display or in any way exploit any of the Content, software, materials provided through the Site in whole or in part.

1.3  Downloads  User may download or copy the Content and other downloadable items displayed on the Site for personal use only, provided that User maintains all copyright and other notices contained in such Content. User shall not store any significant portion of any Content owned by or licensed to KHP in any form. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of KHP and the copyright owner. Copying or storing any Content for other than personal, noncommercial use is expressly prohibited without the prior written permission from KHP, or the copyright holder identified in the individual Content's copyright notice. In the event of any permitted copying, redistribution, or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend, or copyright notice shall be made. User acknowledges that downloading copyrighted material does not transfer any ownership rights to the User.

1.4  Uploads  User shall not upload, post, or otherwise make available on KHP any material protected by copyright, trademark, or other proprietary right without the express permission of the owner of the copyright, trademark, or other proprietary right. The burden of determining that any material is not protected by copyright rests with the User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of KHP, User automatically grants, or warrants that the owner of such material has expressly granted KHP the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other User to access, view, store, or reproduce the material for that User's personal use. User hereby grants KHP the right to edit, copy, publish, and distribute any material made available on KHP by User.

1.5 The foregoing provisions of Sections 1.2, 1.3 and 1.4 are for the benefit of KHP and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on their own behalf.

1.6  Attribution Errors  If you are the owner of intellectual property who believes their intellectual property has been improperly posted or distributed via this web site, please notify,

2.0 Third Party Content

2.1  KHP is a distributor (not a publisher) of content supplied by third parties and Users. Accordingly, KHP has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Users or any other user of KHP, are those of the respective author(s) or distributor(s) and not of KHP. Neither KHP nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. (Refer to Sections 4.0 and 5.0 below for the provisions governing limitation of liabilities and disclaimers of warranty.)

2.2  In many instances, the content available through KHP represents the opinions and judgments of the respective information provider, User, or other user not under contract with KHP. KHP neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on the Site by anyone other than an authorized KHP spokesperson while acting in their official capacities. Under no circumstances will KHP be liable for any loss or damage caused by a User's reliance on information obtained through KHP. It is the responsibility of User to evaluate the accuracy, completeness or usefulness of any information, opinion, advice, or other content available through KHP. Please seek appropriate professional advice regarding the evaluation of any specific information, opinion, advice or other content.

3.0 Access and Availability of Service and Links

3.1  KHP contains links to other related Internet sites. Since KHP is not responsible for the availability of these outside resources or their contents, the User should direct any concerns regarding any external link to the site administrator or Webmaster at that site.

4.0 Representations and Warranties

4.1  KHP neither represents nor endorses the accuracy or reliability of any advice, opinion, statement or other information displayed, uploaded, or distributed through the Site by any User, information provider, or any other person or entity. User acknowledges that any reliance upon any such opinion, advice, statement, memorandum, or information shall be solely at the User's risk. KHP reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Site.

4.2  The Site and all downloadable software and other materials are made available on an "as is" basis without warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose, or noninfringement. User hereby acknowledges that use of the Site is at User's sole risk.

5.0 Disclaimer

5.1  The material in the Site could include technical inaccuracies or other errors. Neither KHP nor any other party involved in the creation, production, or delivery of the Site shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of the User's access to, or use of, the Site. KHP does not warrant that functional aspects of the Site will be uninterrupted or error free, or that the Site or the server that makes it available are free of viruses or other harmful components. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

5.2  KHP reserves the right to make changes to the Site at any time without notice, including moving the Site from one Internet Service Provider to another, or removing the entire Site from the Internet.
